4.1 Free Tier

Our free tier includes basic profile creation, editing capabilities, and private preview functionality.

4.2 Pro Plan

Our Pro plan (subscription fees as displayed on our pricing page) includes all free features plus:

• •Premium AI features
• •Advanced analytics
• •Priority support

4.3 Billing

Subscription fees are billed monthly in advance in United States Dollars (USD). All fees are non-refundable except as expressly stated in our Refund Policy.

4.4 Payment Processing

Payments are processed by Polar (polar.sh), our third-party payment processor. By subscribing to our paid services, you agree to Polar's Terms of Service and Privacy Policy. Polar handles all payment card data and we do not store your full payment information on our servers.

16.1 Mandatory Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, enforcement, interpretation, or validity thereof, or your use of the Service (collectively, "Disputes") shall be resolved by binding arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the Arbitration Rules of SIAC for the time being in force.

16.2 Arbitration Procedures

The arbitration shall be:

• •Held in Singapore
• •Decided by a single arbitrator appointed in accordance with SIAC Rules
• •Conducted on an individual basis only - no class arbitrations or representative actions
• •Subject to confidentiality obligations

16.3 Class Action Waiver

YOU AND NEW INDIGO SOLUTIONS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and New Indigo Solutions agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

16.4 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies for such court and remains in such court.

16.5 Intellectual Property Exception

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights without first engaging in arbitration.

16.6 Costs and Fees

Each party shall bear its own costs and fees in any arbitration, except that New Indigo Solutions will pay all SIAC filing, administration, and arbitrator fees for claims of less than $10,000 USD, unless the arbitrator finds the claims frivolous.

16.7 Opt-Out Right

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to sales@aicandidatehub.com with the subject line "Arbitration Opt-Out" and including your name, email address, and a clear statement that you wish to opt out of this arbitration provision. If you opt out, you may pursue claims in court, but you waive your right to participate in any class action lawsuit.

17.1 Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law, including the U.S. Digital Millennium Copyright Act ("DMCA"), and may terminate accounts of repeat infringers.

17.2 DMCA Takedown Notices

If you believe that content on our Service infringes your copyright, please provide our designated DMCA agent with the following information in writing:

• •A physical or electronic signature of the copyright owner or authorized representative
• •Identification of the copyrighted work claimed to have been infringed
• •Identification of the material claimed to be infringing, with information reasonably sufficient to locate it
• •Your contact information (address, telephone number, email address)
• •A statement that you have a good faith belief that use of the material is not authorized
• •A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

17.4 Counter-Notices

If you believe that material you posted was removed in error, you may submit a counter-notice containing: (a) your physical or electronic signature, (b) identification of the removed material and its former location, (c) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification, and (d) your contact information and consent to jurisdiction of the federal court in your district.

17.5 Repeat Infringer Policy

We may, in appropriate circumstances, terminate the accounts of users who are repeat infringers of intellectual property rights.

18.1 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving its intent. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

18.3 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, Acceptable Use Policy, and any other policies referenced herein, constitute the entire agreement between you and New Indigo Solutions regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

18.4 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18.5 Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent. Any attempted assignment in violation of this section shall be void. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their respective successors and permitted assigns.

18.6 Notices

Any notices or other communications required or permitted under these Terms shall be in writing and given by email to sales@aicandidatehub.com (for notices to us) or to the email address associated with your account (for notices to you). Notices shall be deemed given upon receipt when sent by email during normal business hours, or on the next business day if sent outside normal business hours.

18.7 Survival

The following sections shall survive termination of these Terms: Sections 5 (User Content), 9 (Intellectual Property), 12 (Limitation of Liability), 13 (Indemnification), 15 (Governing Law), 16 (Dispute Resolution and Arbitration), 17 (Copyright and DMCA), and 18 (General Provisions).

The section and subsection headings in these Terms are for convenience only and shall not affect their interpretation.
